When I go back and look at the business structures I was recommending 5+ years ago, I shudder. The rules have changed and people are more litigious then ever before. That means the type of structure you need to use has changed as well. I remember it used to be that the biggest risk to a partnership was the outside world, but in the last year, I’ve seen time and time again how partnership agreements have been used by unscrupulous partners to go after personal assets of the other party. I’m not talking about the business! I’m talking about partnerships that appear to be formed for the sole purpose of stealing from the other person.
